What Are Certified Translations?

Certified translations (also known as sworn translations) are translations performed by a sworn translator. In a certified translation, the entire document is translated, including all elements such as official stamps, company seals, signatures, notations, annotations, and comments. Even empty fields are noted to prevent later additions or alterations.

The certification is provided by a sworn translator using a special seal containing their official information.

It’s important to note that a sworn translator is required to maintain a register, where they log all certified translations accepted for processing.

Who Is a Sworn Translator?

A sworn translator must pass an exam before the State Examination Board, prove their qualifications and education, take an oath before the Minister of Justice, and be listed in the register of sworn translators maintained by the Ministry of Justice.

To become a sworn translator, a candidate must meet the following requirements:

  • hold Polish citizenship or citizenship of an EU member state, EFTA member, Swiss Confederation, or another country under reciprocity;
  • be fluent in Polish;
  • have full legal capacity;
  • have no criminal record for intentional crimes, fiscal crimes, or unintentional crimes related to economic safety;
  • hold a higher education degree;
  • pass an exam testing translation from Polish into a foreign language and vice versa.

Certified Translations – Commonly Translated Documents

Under Polish law, some documents must be translated by a sworn translator if the translation is to retain legal validity. These include notarial acts and documents required by courts, government offices, and state institutions. Any institution requiring a non-Polish document for official purposes will typically require a certified translation (sworn by a certified translator).

These are most often documents such as:

  • school and vocational diplomas
  • court and official documents
  • vehicle-related documents
  • company documents such as invoices and contracts
  • civil-law agreements and similar
  • transcripts and extracts
  • certificates (e.g., tax ID or business registration)
  • birth, death, and marriage certificates
  • baptism and confirmation certificates
  • court rulings and legal documents
  • powers of attorney and authorizations
  • no-claims certificates for vehicles, etc.

Electronic Documents – Qualified Electronic Signature

Electronic documents form a separate category. For these, printing on paper and affixing a physical stamp and signature by the sworn translator is not necessary. In such cases, a qualified electronic signature is perfectly sufficient.

A digital signature complies with the Act on the Profession of Sworn Translator and may be used to sign certified translations. Electronic documents, such as PDFs, can be signed electronically and delivered immediately upon completion of the translation.

Before ordering a certified translation of an electronic document—when you expect the certified translation to be delivered as a file signed with a qualified electronic signature—you should confirm that the office or institution requiring the document accepts this type of electronically signed submission and will not reject it.

It may seem that a sworn translator must be physically present to affix the official seal and signature to a certified translation. That is not true. Translated documents can be sent immediately as scans via email, and the signed originals sent by courier. Increasingly, electronic documents are used, validated by a qualified electronic signature. Once completed, the sworn translator will send electronically signed files, delivering your certified translation within moments.

Certified vs. Standard Translations?

Certified translations are performed and authenticated exclusively by sworn translators. A sworn translator is not inherently better or worse than a non-certified specialist translator—the quality of their work depends on their professional experience, expertise, and skills. A sworn translator has passed an exam before the State Examination Board. However, such exams do not fully test deep-field knowledge or extensive domain experience.

Importantly, a sworn translator performing certified translations is legally obligated to exercise their certification duties (translation and authentication) with particular diligence and impartiality. If a sworn translator performs their duties negligently, they may be held professionally liable, which in extreme cases can lead to revocation of their authorization to practice as a sworn translator.
